Chapter 1 — General Provisions
Article 1 — Purpose

These Terms of Service govern the rights, obligations, responsibilities, and conditions of use between users and HBConnect Co., Ltd. (hereinafter "the Company") in connection with the Onsim service (hereinafter "Onsim") operated by the Company, the digital content (hereinafter "Content") provided by Onsim, and various ancillary services.

Article 2 — Definitions

The terms used in these Terms of Service are defined as follows:

  1. "Onsim" refers to the entity engaged in economic activities related to the content industry, providing Content and ancillary services.
  2. "User" refers to members and non-members who access the Onsim mobile app and use the Content and ancillary services provided by Onsim, whether for free or for a fee, in accordance with these Terms.
  3. "Member" refers to a user who has entered into a use agreement with Onsim, has been assigned an ID, and can continuously receive information from and use services provided by Onsim.
  4. "Non-member" refers to a person who uses services provided by Onsim without being a member.
  5. "Content" refers to data or information expressed in codes, characters, voice, sound, images, or video used in information and communications networks pursuant to Article 2(1)(1) of the Act on Promotion of Information and Communications Network Utilization and Information Protection, etc., which is produced or processed in electronic form to enhance utility in its preservation and use.
  6. "Name" refers to characters used to identify members and enable use of services.
  7. "Paid Service" refers to various online services and ancillary services provided by Onsim for a fee.
  8. "Points/Mileage" refers to a payment method that members may use when using paid services.
  9. Terms used in these Terms of Service that are not defined in this Article shall be governed by applicable laws and general practices.
Article 3 — Disclosure of Identity

Onsim shall post the contents of these Terms, its trade name, representative's name, address of place of business, telephone number, business registration number, and mail-order business report number in a manner that is easily accessible to users.

Article 4 — Posting of Terms
  1. Onsim shall take technical measures to enable members to confirm the contents of these Terms during the course of transactions.
  2. Onsim shall install technical devices that allow users to ask questions about and receive answers regarding these Terms and their contents.
Article 5 — Amendment of Terms
  1. Onsim may amend these Terms within the scope that does not violate applicable laws including the Act on the Development of Online Digital Content Industry, the Act on Consumer Protection in Electronic Commerce, and the Act on the Regulation of Terms and Conditions.
  2. When Onsim amends the Terms, it shall specify the effective date and reason for amendment, post the amended Terms along with the current Terms on the initial screen of the service from at least 7 days prior to the effective date, and send the amended Terms to existing members via email.
  3. When Onsim amends the Terms, it shall confirm whether users consent to the application of the amended Terms after the amendment notice. If a user does not consent to the amended Terms, either Onsim or the user may terminate the Content use agreement. In such case, Onsim shall compensate the user for any damages caused by the termination.
  4. If a member does not expressly express an intention to refuse the amended Terms despite Onsim's notice pursuant to Paragraph 2, the member shall be deemed to have consented to the amended Terms.
Article 6 — Interpretation of Terms

Matters not stipulated in these Terms and the interpretation of these Terms shall be governed by the "Act on the Development of Digital Content Industry," the "Act on Consumer Protection in Electronic Commerce," the "Act on the Regulation of Terms and Conditions," the "Guidelines for Protection of Digital Content Users" established by the Minister of Science and ICT, other applicable laws, or customary practices.

Chapter 2 — Membership Registration
Article 7 — Membership Registration
  1. Membership registration is concluded when a user agrees to the contents of these Terms, submits a membership registration application, and Onsim approves such application.
  2. The membership registration application must include the following information. Items ①–③ are mandatory; all other items are optional.
    • ① Mobile phone number
    • ② Email address
    • ③ Name
    • ④ Other information deemed necessary by Onsim
    • ⑤ Onsim shall in principle approve membership registration applications. However, Onsim may decline to approve applications in the following cases:
      • i. The applicant previously lost membership status under these Terms
      • ii. The applicant used another person's email address
      • iii. The applicant provided false information or omitted required information specified by Onsim
      • iv. Approval is impossible due to reasons attributable to the user, or the application violates other specified requirements
  3. Onsim may defer approval if there is insufficient capacity in service-related facilities, or if there are technical or operational issues.
  4. The membership agreement is deemed to have been formed at the time Onsim's approval reaches the user.
Article 8 — Special Provisions for Minors
  1. Onsim may cancel the registration of users under the age of 16 if service provision is not possible for such users.
  2. Legal representatives (e.g., parents) of users under the age of 16 may request access, correction, or updates to personal information about the child, or withdraw consent to membership registration. In such cases, Onsim shall take necessary measures without delay.
Article 9 — Changes to Member Information
  1. Members may view and modify their personal information through the account settings screen.
  2. If any information provided at the time of membership registration changes, members must update it online or notify Onsim of the change by email or other means.
  3. Onsim shall not be liable for any disadvantages arising from a member's failure to notify Onsim of changes pursuant to Paragraph 2.
Article 10 — Obligations for Managing Member Credentials
  1. Members are responsible for managing their name, mobile phone number, and other credentials and must not allow third parties to use them.
  2. If a member becomes aware that their name, mobile phone number, or other credentials have been stolen or are being used by a third party, the member must immediately notify Onsim and follow Onsim's guidance.
  3. Onsim shall not be liable for any disadvantages arising from a member's failure to notify Onsim of such facts, or from failing to follow Onsim's guidance after notification.
Article 11 — Notifications to Members
  1. When Onsim notifies a member, it may do so via the email address designated by the member.
  2. For notifications to all members, Onsim may substitute individual notification by posting on Onsim's notice board for at least 7 days. However, for matters that have a significant impact on a member's individual transactions, individual notification as provided in Paragraph 1 shall be given.
Article 12 — Withdrawal and Loss of Membership
  1. Members may request withdrawal from Onsim at any time, and Onsim shall process the withdrawal after verification.
  2. Onsim may restrict or suspend membership if any of the following occurs:
    • ① Registration of false information at the time of membership application
    • ② Failure to fulfill payment obligations related to Onsim's service fees or other debts arising from the use of Onsim's services by the due date
    • ③ Interference with other users' use of Onsim's services, misappropriation of others' information, or other acts that threaten the order of electronic commerce
    • ④ Use of Onsim to engage in acts prohibited by law or these Terms, or acts contrary to public policy and morals
  3. If the same violation occurs two or more times after Onsim has restricted or suspended membership, or if the cause is not remedied within 30 days, Onsim may terminate membership.
  4. When Onsim terminates membership, it shall cancel the member's registration, notify the member, and provide at least a 30-day opportunity to present a defense before cancellation.
Chapter 3 — Content Use Agreement
Article 13 — Display of Content Information
  1. Onsim shall display the following information clearly on the initial screen for each piece of Content:
    • ① Title or name of the Content
    • ② Date of production and display of the Content
    • ③ Name (or trade name for corporations or individual business operators), address, and telephone number of the Content creator
    • ④ Content details, method of use, fees, and other terms of use
  2. Onsim shall provide users with information about compatible devices and minimum technical specifications required to use each piece of Content during the contract formation process.
Article 14 — Formation of Use Agreement
  1. Users shall apply for use through the following or similar procedures provided by Onsim. Onsim shall provide information so that users can accurately understand the following matters and transact without error or mistake before concluding a contract.
    • ① Confirmation and selection of paid services
    • ② Selection of payment method and entry of payment information
    • ③ Confirmation of the application for use of paid services, or consent to Onsim's confirmation
    • ④ Confirmation of the contents, method of use, fees, and other terms of the paid service
  2. Onsim may decline to approve or may defer approval of a user's application in the following cases:
    • ① Use of a name other than the user's real name, or use of another person's name
    • ② Provision of false information or omission of required information specified by Onsim
    • ③ A minor attempting to use content whose use is prohibited under the Juvenile Protection Act
    • ④ Insufficient capacity in service-related facilities, or technical or operational issues
    • ⑤ Unauthorized use of a payment method without the account holder's consent
    • ⑥ Other cases deemed impossible to approve due to reasons attributable to the member
  3. The use agreement is deemed to have been formed at the time the "Payment Complete" status is displayed in the application process.
  4. To use paid services, members must pay the applicable fees in accordance with the terms of each service after agreeing to these Terms.
Article 15 — Special Provisions for Minor Users

When a minor user under the age of 20 wishes to use paid services, Onsim shall notify the minor user, prior to contract formation, that the contract may be cancelled by the minor user themselves or their legal representative (e.g., parent) if consent from a legal representative is not obtained beforehand or ratification is not obtained after contract formation.

Article 16 — Confirmation Notice and Changes/Cancellation
  1. When a user applies for use, Onsim shall send a confirmation notice to the user.
  2. A user who has received a confirmation notice may immediately request changes or cancellation of the application if there is a discrepancy in the expression of intent. Onsim shall process such requests without delay if made before service provision. However, if payment has already been made, the provisions of Article 28 (Withdrawal) shall apply.
Article 17 — Obligations of Onsim
  1. Onsim shall exercise its rights and fulfill its obligations as prescribed by law and these Terms in good faith.
  2. Onsim shall establish a security system to protect personal information so that users can safely use Content, and shall publish and comply with its privacy policy.
  3. Onsim shall take measures so that users can check their Content usage and payment details at any time.
  4. If Onsim recognizes that an opinion or complaint raised by a user regarding Content use is legitimate, it shall address it without delay and communicate the process and result via notice boards or email.
  5. Onsim shall compensate users for damages caused by Onsim's breach of obligations stipulated in these Terms.
Article 18 — Obligations of Users
  1. Users must not engage in the following:
    • ① Entering false information when applying or making changes
    • ② Misappropriating another person's information
    • ③ Altering information posted on Onsim
    • ④ Transmitting or posting information prohibited by Onsim
    • ⑤ Infringing on the copyrights or other intellectual property rights of Onsim or third parties
    • ⑥ Damaging the reputation of Onsim or third parties, or interfering with their business
    • ⑦ Posting or publishing obscene or violent language, writings, images, sounds, or other information contrary to public policy and morals on Onsim's site
    • ⑧ Any other illegal or improper acts
  2. Users must comply with applicable laws, these Terms, usage guidelines, notices related to Content, and matters communicated by Onsim, and must not engage in any acts that interfere with Onsim's business.
Article 19 — Payment Methods
  1. Payment methods and related matters for the use of Onsim's paid services are as follows:
    • ① Points and mileage are cyber currency that can be used to use or purchase various paid services provided by Onsim.
    • ② Charging of points and mileage is limited to the amounts displayed on the charging screen.
    • ③ There is no restriction on charging points and mileage; however, the payment provider designated by the member may have separate usage limits.
    • ④ The charging and usage history of points and mileage can be checked on the Onsim site.
    • ⑤ No interest is earned on the balance of points and mileage.
  2. Payment for the use of paid services may be made by any of the following available methods. Onsim shall not impose any additional fees on users for their payment method.
    • ① Bank transfer (without passbook)
Article 20 — Duration of Paid Services
  1. Unless separately indicated in advance, the duration of use for purchased paid services shall be maintained for as long as the relevant paid service continues. However, this excludes cases where the service content is changed or the service is terminated due to the expiration of Onsim's contract with a Content Provider (CP), changes to CPs, or the launch of new services.
  2. Onsim shall do its best to ensure that members can continue to use Content already purchased, even after the relevant paid service ends.
Article 21 — Provision and Suspension of Content Services
  1. Content services shall in principle be provided 365 days a year, 24 hours a day.
  2. Onsim may temporarily suspend the provision of Content services for maintenance, replacement, or repair of computers and other information and communications equipment, communication failure, or other significant operational reasons. In such cases, Onsim shall notify users by the method prescribed in Article 11 [Notifications to Members]. However, if there are unavoidable circumstances preventing prior notice, Onsim may notify users after the fact.
  3. Onsim shall compensate users for damages incurred due to a temporary suspension of Content services without significant reason. However, this shall not apply if Onsim proves that it had no intent or negligence.
  4. Onsim may conduct periodic maintenance as necessary for the provision of Content services, and the maintenance schedule shall be as announced on the service provision screen.
  5. If Onsim is unable to provide Content services due to a change in business category, abandonment of business, or merger with another company, Onsim shall notify users by the method prescribed in Article 11 [Notifications to Members] and compensate users in accordance with the conditions originally presented by Onsim.
Article 22 — Changes to Content Services
  1. Onsim may change the Content services it provides in accordance with operational or technical needs when there is a significant reason to do so.
  2. When Onsim changes the content, method, or hours of Content services, it shall post the reason for the change, the content of the changed service, and the date of provision on the initial Content screen for at least 7 days prior to the change.
  3. Where changes in Paragraph 2 are significant or disadvantageous to users, Onsim shall notify and obtain consent from users of the relevant Content service by the method in Article 11. Onsim shall provide the pre-change service to users who refuse consent. However, if such service provision is impossible, Onsim may terminate the agreement.
  4. Onsim shall compensate users for damages caused by service changes pursuant to Paragraph 1 or contract termination pursuant to Paragraph 3.
Article 23 — Information Provision and Advertising
  1. Onsim may provide members with various information deemed necessary during Content use through notices, email, text messages, or other means. However, members may refuse receipt of such communications via email, text messages, or other means at any time.
  2. If Onsim wishes to transmit information pursuant to Paragraph 1 via telephone or fax, it shall obtain the member's prior consent before transmission.
  3. Onsim may display advertisements on Content screens, its website, email, text messages, and other channels in connection with the provision of Content services. Members who receive emails or text messages containing advertisements may request that Onsim stop sending such communications.
Article 24 — Deletion of Posts
  1. If harmful-to-youth content in violation of the Act on Promotion of Information and Communications Network Utilization and Information Protection, etc. is posted on Onsim's bulletin boards, Onsim shall delete it without delay. However, bulletin boards accessible only to users aged 19 or older are excluded.
  2. Any person whose legal interests are infringed by information posted on Onsim's bulletin boards or other channels may request Onsim to delete the information or post a rebuttal. In such cases, Onsim shall take necessary measures without delay and immediately notify the applicant.
Article 25 — Ownership of Intellectual Property Rights
  1. Copyrights and other intellectual property rights in works created by Onsim vest in Onsim.
  2. Copyrights and other intellectual property rights in works provided through partnership agreements among services provided by Onsim vest in the respective providers.
  3. Users must not reproduce, transmit, publish, distribute, broadcast, or otherwise use for commercial purposes, or permit third parties to use, any information obtained through Onsim's services in which Onsim or a provider holds intellectual property rights, without prior approval from Onsim or the provider.
  4. If Onsim uses a user's creative works pursuant to an agreement, Onsim shall obtain that user's permission.
Article 26 — Protection of Personal Information
  1. Onsim may collect the minimum information necessary for users' Content use in addition to the information listed in the membership application under Article 7(2). Users must truthfully and faithfully disclose information when queried by Onsim for this purpose.
  2. When Onsim collects personally identifiable information, it shall obtain consent from the relevant user.
  3. Onsim may not use or provide to third parties, without the user's consent, information provided by users in use applications or collected under Paragraph 1 for purposes other than those intended. Onsim shall bear all responsibility for violations. However, the following exceptions apply:
    • ① Cases where information is provided in a form that does not identify specific individuals for statistical compilation, academic research, or market research
    • ② Cases where the information is necessary for billing purposes related to Content provision
    • ③ Cases where identity verification is necessary to prevent misappropriation
    • ④ Cases where there is an inevitable reason required by the terms or applicable law
  4. When Onsim is required to obtain user consent under Paragraphs 2 and 3, it shall specify and notify users of the identity of the personal information manager (affiliation, name, telephone number, and other contact information), the purpose of collection and use, and matters related to the provision of information to third parties (recipient, purpose of provision, and content of information to be provided), as stipulated in Article 22(2) of the Act on Promotion of Information and Communications Network Utilization and Information Protection, etc.
  5. Users may withdraw their consent under Paragraph 3 at any time.
  6. Users may request access to and correction of errors in their personal information held by Onsim at any time, and Onsim shall take necessary measures without delay. While a correction request is pending, Onsim shall not use the relevant personal information until the error has been corrected.
  7. Onsim shall minimize the number of administrators of personal information and shall be responsible for any damage to users arising from the loss, theft, leakage, or alteration of personal information including names, contact information, email addresses, and bank account details.
  8. Onsim or any person who has received personal information from Onsim may use personal information only within the scope consented to by the user, and shall destroy the personal information without delay once the purpose has been fulfilled.
  9. Onsim shall endeavor to protect users' personal information in accordance with applicable laws including the Act on Promotion of Information and Communications Network Utilization and Information Protection, etc. Protection and use of personal information shall be governed by applicable laws and Onsim's Privacy Policy.
Chapter 4 — Withdrawal, Cancellation & Restrictions
Article 27 — User Withdrawal and Cancellation
  1. Users who have entered into a Content use agreement with Onsim may withdraw their application within 7 days of receiving the confirmation notice. However, the user's right of withdrawal may be restricted if Onsim has taken any of the following measures:
    • ① Including a statement indicating that withdrawal is not available for the relevant Content in its display information
    • ② Providing a trial product
    • ③ Providing access on a time-limited or partial-use basis
  2. Users may cancel or terminate a Content use agreement within 6 months of receipt of the Content, or within 30 days of knowing or being able to know of the cause, in any of the following cases:
    • ① Content agreed upon in the use agreement is not provided
    • ② Content provided differs significantly from its representations or advertisements
    • ③ Normal use is significantly impaired due to other defects in the Content
  3. Withdrawal pursuant to Paragraph 1 and cancellation/termination pursuant to Paragraph 2 shall take effect when the user expresses their intent to Onsim by telephone, email, or fax.
  4. Upon receiving the user's expression of intent to withdraw or cancel/terminate pursuant to Paragraph 3, Onsim shall promptly reply to the user confirming receipt.
  5. Before expressing an intent to cancel/terminate for reasons under Paragraph 2, users may set a reasonable period and request Onsim to cure the defect in the Content or service.
Article 28 — Effects of User Withdrawal and Cancellation
  1. Onsim shall refund the payment using the same method as the original payment within 7 business days from the date the user expressed withdrawal intent, or from the date Onsim replied regarding the intent to cancel/terminate. If refund by the same method is not possible, this shall be notified in advance. If Onsim delays a refund, it shall pay delay interest calculated by multiplying the delay period by the delay interest rate determined and publicly announced by the Fair Trade Commission.
  2. When refunding pursuant to Paragraph 1, Onsim may deduct an amount corresponding to the benefit the user obtained from using the service.
  3. When refunding payment that was made via bank transfer, Onsim shall promptly request the payment service provider to stop or cancel the billing for the goods or services. However, this may not apply if a deduction under Paragraph 2 is necessary.
  4. If the party that received payment for Onsim, Content, or other items and the party that entered into the Content use agreement with the user are different, they shall be jointly liable for obligations related to refunds arising from withdrawal or cancellation/termination.
  5. Onsim shall not claim penalties or damages from users for withdrawal. However, a user's cancellation/termination does not affect a claim for damages.
Article 29 — Onsim's Right to Cancel and Restrict
  1. If a user engages in the acts specified in Article 12(2), Onsim may cancel/terminate the agreement without prior notice or restrict service use for a specified period.
  2. Cancellation/termination under Paragraph 1 shall take effect when Onsim communicates its intent to the user in the manner prescribed by Onsim.
  3. Users may file an objection against Onsim's cancellation/termination or service restriction in accordance with the procedures established by Onsim. If Onsim recognizes the objection as legitimate, Onsim shall immediately resume service.
Article 30 — Effects of Onsim's Cancellation

The effects of cancellation/termination of the use agreement due to reasons attributable to the user shall be governed mutatis mutandis by Article 28. However, Onsim shall refund the payment using the same method as the original payment within 7 business days from the date Onsim expressed its intent to cancel/terminate to the user.

Chapter 5 — Erroneous Charges & Compensation
Article 31 — Erroneous Charges
  1. If an erroneous charge occurs, Onsim shall refund the full amount of the erroneous charge using the same method as the original payment. If refund by the same method is not possible, this shall be notified in advance.
  2. If an erroneous charge occurs due to reasons attributable to Onsim, Onsim shall refund the full amount of the erroneous charge regardless of contract costs or fees. However, if an erroneous charge occurs due to reasons attributable to the user, the costs incurred by Onsim in making the refund shall be borne by the user within a reasonable range.
  3. If Onsim refuses to refund an erroneous charge claimed by a user, Onsim shall bear the burden of proving that the fee was legitimately charged.
  4. Onsim shall process erroneous charge refund procedures in accordance with the Guidelines for Protection of Digital Content Users.
Article 32 — Compensation for Content Defects

Onsim shall handle matters related to the standards, scope, method, and procedure of compensation for user damages caused by Content defects or similar issues in accordance with the Guidelines for Protection of Digital Content Users.

Article 33 — Disclaimer of Liability
  1. Onsim shall be exempt from liability for the provision of Content if it is unable to provide Content due to natural disasters or other force majeure events.
  2. Onsim shall not be liable for disruptions to Content use caused by reasons attributable to the user.
  3. Onsim shall not be liable for the reliability, accuracy, or other aspects of information, data, or facts posted by members in connection with Content.
  4. Onsim shall not be liable for disputes arising between users or between users and third parties mediated through Content.
Article 34 — Dispute Resolution

In the event of a dispute, Onsim shall take appropriate and prompt measures by reflecting legitimate opinions or complaints raised by users. However, if prompt resolution is difficult, Onsim shall notify the user of the reason and processing schedule.

These Terms shall be effective from March 28, 2025. Onsim values your personal information and complies with the relevant provisions of applicable laws including the Act on Promotion of Information and Communications Network Utilization and Information Protection, the Personal Information Protection Act, the Protection of Communications Secrets Act, and the Telecommunications Business Act, which information and communications service providers are required to observe. Onsim endeavors to protect user rights. Through its Privacy Policy, Onsim informs users about the purposes and methods by which personal information provided by users is used, and the measures taken to protect such personal information.
